Australia Business Skills Visa Summary

 
From 1st March, 2003 on, Business Skills visa’s applicant can not get a permanent Business Skills visa immediately, that will be separated into two steps:

 

First and foremost, the applicant will get a 4-year provisional visa conditionally. During this period, if you establish a new or existing business and meet all the demand of government, then you can apply for a permanent Business Skills visa.

But the state State/Territory Sponsored Business Owner can still get a permanent Business Skills visa, this kind of visa is called “Business Talent Migrant (Subclass 132)”


Applicants in China can apply for permanent Business Skills visa, including:

Receiving permanent right to reside in Australia, and all the dependent family members can get green visa with the applicant

Business Talent Migrant (Subclass 132)

 

Applicants in China can also apply for provisional Business Skills visa, including:

 

This could be separated into three parts: business owner, senior executive and investor. Each part also includes two kinds: with or without state sponsorship. The applicant who doesn’t have state sponsorship must be under 45 years old and has IELTS grade above 5.0; the applicant who has state sponsorship must be under 55 years old and doesn’t need IELTS grade.

4.   For at least 2 of fiscal year immediately before the application is made, you(or you and your spouse together)had an net assets in a qualifying business , in which you had an ownship interest , of at least AUD 400,000

5.   Your (or your spouse’s) combined) business and personal asstes have a net value of at least AUD 1,500,000

6.   You are aged less than 55years of you are proposing to establish or participate in a business that you sponsoring state or territory ahs determined is of exceptional economic benefit to the state or territory

Business Owner (Provisional) (Subclass 160)

 

You need to have: 

 

1.   You have an overall successful business career.

2.   Your (and your spouse's combined) total assets have a value of at least 200,000 AUD in a qualifying business (or 2 businesses combined) for at least 2 of the 4 fiscal years immediately before applying

3.   For at least 2of the 4 fiscal years immediately before the application is made, you main business , or up to 2 main businesses together , had an annual turnover of at least AUD 500,000;

4.   Your (and your spouse's combined) total assets have a value of at least AUD 500,000 to settle in Australia.

5.   You have an vocational English

6.   You are aged less than 45years at time of application

 

Senior Executive (Provisional) Visa (Subclass 161)

 

You need to have: 

  1. You have an overall successful business career
  2. For at least 2 of 4years immediately before the application is made, you have occupied a position in the 3 highest levels of the management structure of a major business.
  3. The company must have had an annual turnover of at least 50,000,000AUD for 2 of the last 4 fiscal years
  4. You (or you and your spouse together) have a business and personal assets, have a net value of at least AUD 500,000 and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.
  5. You have an vocational English
  6. You are aged less than 45years at time of application

 

Investor (Provisional) (Subclass 162)

 

You need to have:

 

  1. you have to showed that you have an overall successful business/investment activity
  2. You have total at least 3yeares experience of direct involvement in managing one or more qualifying business of eligible investments.
  3. For at least one of the 5 fiscal years immediately before the application is made:

-     You have maintained direct involvement in either managing a qualifying business in which you(or you spouse together) have an ownership interest of at least 10% of the total value of the business or

-     You maintained direct involvement in managing you (or your and your spouse’s) combined) eligible investment or qualifying business activity.

 

  1. The net value of your (or your and your spouse's combined) assets was at least A$2,250,000 for the two fiscal years immediately before you apply
  2. You have demonstrated a high level of management skill in relation to an eligible investment of qualifying business activity.
  3. you have made a government approved Designated Investment of 1,500,000 AUD in a state or territory prior to decision being made
  4. You have an vocational English
  5. You are aged less than 45years at time of application

 

State/Territory Sponsored Business Owner (Provisional) (Subclass 163)

 

Business owner (Provisional) (Subclass 163A)

 

       1.   You must be sponsored by an appropriate regional authority of a State or Territory Government.

2.   You must have an overall successful business career.

3.   You must have an ownership interest in a main business (or two main business combined) with an annual turnover of at least AUD$300,000 in at least two of the four fiscal years immediately before you apply.

4.   Your (and your spouse's combined) total assets have a net value of at least AUD$250,000 and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.

5.   You must be less than 55 years old (except where the regional authority considers that the proposed business will be of exceptional economic benefit to the region.)

 

Business owner (Provisional) (Subclass 163B)

 

1.   You must be sponsored by an appropriate regional authority of a State or Territory Government.

2.   You must have an overall successful business career.

3.   You are a senior manager in a main business with an annual turnover of at least AUS$ 1,000,000 in at least three of five fiscal years immediately before you apply.

4.   Your (and your spouse's combined) total assets have a net value of at least AUD$250,000 and were legally acquired and are capable of being transferred to Australia within two years of being granted this visa.

5.   You must be less than 55 years old (except where the regional authority considers that the proposed business will be of exceptional economic benefit to the region.)

 

State/Territory Sponsored Senior Executive (Provisional) (Subclass 164)

 

  1. You have an overall successful business career
  2. For at least 2 of 4years immediately before the application is made, you have occupied a position in the 3 highest levels of the management structure of a major business. in which you were responsible for strategic policy development affecting a major component or a wile range of operations of that major business
  3. The company must have had an annual turnover of at least 10,000,000AUD for 2 of the last 4 fiscal years
  4. You (or you and your spouse together) have business and personal assets have a net value of at least AUD 250,000. 
  5. You are aged less than 45years at time of application
  6. No English requirement

 

State/Territory Sponsored Investor (Provisional) (Subclass 165)

 

1.  You must be sponsored by an appropriate regional authority of a State or Territory government.

2.  You have total at least 3yeares experience of direct involvement in managing one or more qualifying business of eligible investments.

3.  For at least one of the 5 fiscal years immediately before the application is made:

-  You have maintained direct involvement in either managing a qualifying business in which you(or you spouse together) have an ownership interest of at least 10% of the total value of the business

-  or: You maintained direct involvement in managing you (or your and your spouse’s) combined) eligible investment or qualifying business activity.

4.   The net value of your (or your and your spouse's combined) assets was at least A$1,125,000 for the two fiscal years immediately before you apply

5.   You have demonstrated a high level of management skill in relation to an eligible investment or qualifying business activity

6.   You have made a government approved Designated Investment of 1,500,000 AUD in a state or territory prior to decision being made

1You are the holder of one of the following visas:

3.At time of decision, the designated investment held in your name (or you and your spouse together) has been held continuously for at least 4 years.

 

State/Territory Sponsored Business Owner (Residence) (Subclass 892)

 

      1. You have been sponsored by an appropriate regional authority of a state or territory government.

2. You are the holder of one of the following visas:

l  Business Owner (Provisional)

l  State/Territory Sponsored Business Owner (Provisional)

l  Senior Executive (Provisional)

l  State/Territory Sponsored Senior Executive (Provisional)

l  Investor

l  State/Territory Sponsored Investor (Provisional)

l  Business (Long Stay) Independent Executive visa

l  Skilled – Independent Regional (Provisional)

3. In your main business (or two main businesses) in Australia, you have had and continue to have an ownership interest and direct and continuous management for at least two years immediately before you apply.

4. You must also meet at least two of the following three requirements (unless the appropriate state/territory authority has determined there are exceptional circumstances).

Net business assets

The net value of your (or your and your spouses combined) assets in the main business (or two main business) in Australia is at least A$75,000 throughout the 12 months immediately before you apply.

Net personal and business assets

The net value of your (or you and your spouse's combined) personal and business assets in Australia has been at least A$250,000 throughout the 12 months immediately before you apply.

Provided employment

Throughout the 12 months immediately before you apply your (or your and your spouses) business or two main businesses employed at least the equivalent of one full-time employee who are:

· Australian citizens

· Australian permanent residents

· New Zealand passport holders

· Not members of your family

5. The net value of your (or you and your spouse's combined) personal and business assets in Australia has been at least A$250,000 throughout the 12 months immediately before you apply.

6. You must have been in Australia as the holder of one of the qualifying visas for a total of at least one year in the two years immediately before you apply

 

State/Territory Sponsored Investor (Residence) (Subclass 893)

 

1. You have been sponsored by an appropriate regional authority of a state or territory government.

2. You are the holder of a State/Territory Sponsored Investor (Provisional) visa

3. You have been in Australia for at least 2 of the 4 years immediately before you apply.

4. At time of decision, the designated investment held in your name (or you and your spouse together) has been held continuously for at least 4 years.

 

Established Business in Australia (Subclass 845)

 

1.    You hold an appropriate provisional visa and has established business in Australia

2.    You are the holder of a visitor visa, student visa or temporary resident visa, which is not a special purpose visa, border visa, diplomatic visa, domestic worker visa or transit visa.

3.    You have an overall successful business career.

4.    You have been in Australia as a temporary resident for at least 12 months cumulatively out of the last 24 months before the date of application.

5.    You have held an ownership interest of at least 10% in up to two main businesses in a designated area of Australia for at least two years immediately before applying and continue to have an interest of that kind.

6.    Your (or your and your spouse's) total net assets in Australia were at least A$250,000 for the two years before you apply.

7.    Your (or your and your spouse's) have had business assets in Australia of more than 100,000 AUD for 12 months before you apply

8.    You have been actively involved in, and directly responsible for, the day to day management and overall performance of your main business (or two main businesses) for the 24 months before you apply.

9.    You have not been involved in business or investment activities considered unacceptable in Australia.

10.  You must score at least 105 points in the regional established business in Australia points test
